Tango your a copper? (i think..)

If your car fails the MOT, And you still have a pass cert for a future date.

Is your pass nullified, or is it still valid.

Having an arguement on another forum and some people are saying one, some the other.

Surely if your cars failed. It's dangerous. So it will nullify the pass.

(all MOT testers / testers to be are saying it's still valid..)

in the new law, if it fails, it fails and your current MOT is useless.

Even if the MOT certificate you currently hold has a certain date.

If it's deemed dangerous or unsafe, and not road worthy, hence the MOT in the first place, it does make sense. Bit of a bitch though as it's only been like that for a while..

The MOT certificate confirms that at the time of the test, without dismantling it, the vehicle met the minimum acceptable environmental and road safety standards required by law. It doesn’t mean that the vehicle is roadworthy for the length of time the certificate is valid.

From this link it implies that if car fails MOT and deemed by tester to fail on an item which makes the car in an 'un-road worthy' condition then it would be an offence.
However unless fails on a significant item then cant see it being issue, as say for example emissions are out due to cat failure, this would fail the MOT however would not make the car un road worthy.

If in principal any MOT failure makes it an offence to take on the road afterwards (even if still covered by an existing valid ticket) how would you ever get home?

I believe it’s down to what is deemed un-road worthy

10. VT30 –Refusal of an MOT Test Certificate (See Appendix 7 – Example 2) This must be printed via the VTS Device except when operating in Fallback or ET. (See Section N & Appendix 7) or when the printer has become unserviceable (and the fault reported to VOSA Service Desk), then test documents will be handwritten. Following test registration a VT30 must be issued: a. When an NT refuses to test a vehicle for any of the qualifying reasons set out in Appendix 3 and the vehicle presenter requests a ‘refusal to test’ decision in writing; b. When a test has to be abandoned because the NT considers it unsafe to continue or because it has become apparent during the test that certain items cannot be satisfactorily examined. In these instances the NT must complete as much of the test as possible and include any failure defects found during the partial test and give the reason why it was considered that the test could not be completed. See Appendix 7, Example 3. c. When a test is aborted due to a problem with VTS equipment or NT. See Appendix 7 – Example 4. d. When a test is completed and the vehicle has failed to meet the required standards, it must detail the reasons for failure and be signed by the NT who carried out the test. If the vehicle remains at the VTS for repairs, that are likely to take more than 1 hour to complete, a VT30 must be issued on completion of the test. If the NT decides to use the PRS facility, see Section B5 paragraph 10, then he must complete the test before repairs are carried out. Once the repairs are complete the NT must register the results on the VTS Device and issue a VT30 in addition to a VT20 e. If the NT considers an item on the vehicle, whether testable or not, to be so defective as to render the vehicle dangerous to drive on the road, the NT must warn the vehicle presenter of the nature of such defects. This must be recorded in box C of the VT30 as appropriate. Dangerous defects must be clearly explained to the vehicle presenter. Note: NB. If a VT30 is not issued dangerous defects must be notified to the vehicle presenter on a VT32. 11 VT32 – Advisory Notice (see Appendix 7 – Example 6) This is used to advise the vehicle presenter of any items that in opinion of the NT require written notification. For example: · a testable item which is only just passable and may need attention soon; or · an item which is not within the scope of the MOT test and may need attention; or · any peculiarity of the vehicle (e.g. front passenger seat missing). If the NT considers an item on the vehicle, whether testable or not, to be so defective that it renders the vehicle dangerous to drive on the road, the NT must notify the vehicle presenter of the nature of such defects. This must be recorded in box C of the VT32 as appropriate. All dangerous defects must be explained to the vehicle presenter.

Well my car failed as the tyres were gonna go bang any second. The emmisions, brakes etcetc. But you have to have a way to get it to and from the garage. Which is why that law is there. It's your own fault (mine as well) if you don't keep ontop of general maintenance.
If it fails. Then it should just be failed until it's passed. That way there's no confusion.

im not entirely sure it works the same for cars. you may present your vehicle for test and return from that test even if it fails. as you are entitled to a second opinion and you may also wish to have the repairs done elsewhere. however. if you present a vehicle which is in a DANGEROUS condition..and were not talking bulbs and a smelly exhaust here. serious defects which are likely to injur you or another person a prohibition notice can be issued. and that vehicle cant be used on a public highway the vehicle has to be transported away, until those defects have been rectified and it is returning for re examination.

i only deal with the bigger stuff so i do apologise if thats a bit wrong for a car. but ive never presented a car for an mot knowing its got a serious issue. with brakes/suspension/bald tyres etc

there is a fairly comprehensive checklist in every haynes manual regarding testable items. even weekly checks on your car help you spot things early enough for them not to become serious issues.

just asked my sarg, he said even if it fails a new test it still has ticket off the old one so your ok to drive it to get the bits fixed!!

Yeah I know you can drive to get the bits fixed. But can you just drive it around even though it's failed just because it passed the year before and that ticket isn't out of date :P
